Welcome to Woven 4U.net, LLC. You can place an order (“Order”) on this Website with Woven 4U.net, LLC (W4U) to manufacture towels for you or purchase other items as available (collectively “Products”).  By visiting or shopping at Woven 4U.net, you accept the terms and conditions set out herein. Please read them carefully.

TERMS AND CONDITIONS OF SALE

Sales Tax
1. Sales Tax (for sales to residents of Colorado and Georgia) are included in all invoices. Residents of other States are responsible for all sales/use taxes if applicable.
 
Manufacturing and Delivery Dates
1. Delivery dates ex factory for the towels are usually 2 -4 weeks from receipt of Order and payment and do NOT include shipping time to you or a third party.

2. All Orders must be paid for by credit card, direct debit, gift card, or gift certificate before manufacturing is commenced.

3. W4U shall not be liable for any delays or failures in performance due to reasons beyond the control of W4U such as Acts of God, war, terrorism, riots, fire, explosion, flood, strike and labor disputes, lockout, injunction, inability to obtain fuel, power, raw materials, breakage of machinery, governmental action or any other cause beyond the control of W4U.

4. W4U will not, in any way, be liable for any delay in delivery or for the performance of the towels.

Minimum Order Quantities
1. Currently the minimum quantities for the towels are one per design but the minimum quantities are subject to variation depending on the Product.
 
Passing of Risks
1. You acknowledge that all risk of loss of the Product passes to you when the Product leaves the manufacturing premises for dispatch to the you or third party regardless of whether you have requested W4U to arrange the delivery or otherwise.  
 
Acknowledgment of Purchaser
1.  You acknowledge that there may be discrepancies between your monitor’s display of any color and/or graphic and the actual colors and graphics produced on the Product.

2. You hereby release W4U from all responsibilities or liabilities (whether with respect to damages, return of towel for credit or otherwise) as a result of any variances between the appearance of colors and /or graphics displayed on your monitor and on any Product.

3. W4U reserves the right to change the color of the top and bottom borders as well as the text without prior notice or approval of the purchaser.

Cancellation
1. If for some reason you have to cancel any Order, the cancellation must be processed immediately. If the Order is already in production, the Order cannot be cancelled because of personalization. If the product is not yet in production, W4U will cancel the Order and a refund will be processed within 7 business days of the date of receipt of the cancellation request.

2. In the event that your Order cannot be cancelled, no refund will be due and the towels will be delivered as per the order. Should you or a third party refuse delivery or fail to collect the product as pursuant to the Order, delivery is deemed accepted when the product leaves the manufacturing facility. Any product returned undeliverable to the W4U manufacturing facility will not be entitled to any refund.

Return Policy
1. W4U will refund the full purchase price to you should any Product proven to be faulty due to a material or manufacturing fault only and such refund is requested within 7 working days of the date of delivery of the towel. A Refund of the total purchase price is the your sole and exclusive remedy and the sole and exclusive liability of W4U for any faulty product.
 
2. Please keep a copy of the W4U invoice and record of delivery date.  This information will be required to make any return
 
3. If the towel has a material or manufacturing fault, simply send it  freight pre-paid to:

To return an item:
•    Please include a copy of the Invoice with the faulty towel.
•    Please note the reason for the return and date of delivery. (Please note that minor shrinkage and pilling in the first 2-3 washes are not regarded as faults.)
•    Pack and seal the towel securely.
•    Packages must be returned freight prepaid.
•    W4U cannot accept C.O.D. deliveries.
•    We recommend the use of an insured Courier or USPS service.
•    All credit card returns will be refunded to the original credit card/debit card used for the purchase.
•    Credits will be processed with in 7 days from the receipt of the faulty product. However, there may be delays beyond our control in receiving any credit, due to the card processor or the your bank.

Order Acceptance
1. Your receipt of an order confirmation does not necessarily confirm our acceptance of your order or constitute confirmation of our offer to sell. W4U reserves the right to decline your order for any reason. If we decline your order, we will refund any charges made to your card.

Applicable Law
1. All matters and disputes arising from the sale of the Products or use of this website shall be governed in all respects by the laws of the State of Colorado. Purchaser agrees that any claim or dispute against W4U must be resolved by a court located in El Paso County, Colorado. You agree to submit to the personal jurisdiction of the courts located within El Paso County, Colorado for the purpose of litigating all claims or disputes.
 
Severed Provisions
1.If any paragraph or any part of a paragraph, or any clause or phrase herein is deemed unenforceable for any reason, the said paragraph, part paragraph, clause or phrase shall be deemed struck out; but the remainder on these Terms and Conditions shall be valid and enforceable.
